The following are various legal notices that Google is obligated to provide by law and/or by contract (the "Legal Notices"). The Legal Notices are incorporated by reference into the Google Maps/Google Earth Terms of Service and the Google Maps/Google Earth APIs Terms of Service. By using Google Maps, Google Earth, or the Google Maps/Google Earth APIs (collectively, the "Products"), you are agreeing to be bound by these Legal Notices. Unless otherwise specified, capitalized terms used in these Legal Notices have the meanings described in the Google Terms of Service, the Google Maps/Google Earth Terms of Service, and the Google Maps/Google Earth APIs Terms of Service.
1Standards. Google Maps and Google Earth rely on widely-recognized international standards for naming and mapping conventions. For example, for country and territory naming, we rely primarily on the ISO-3166 standard, which is recognized by the UN Statistics Division.
2U.S. Government Restricted Rights. If any Product is used or accessed by or on behalf of the United States government, such use or access is subject to the following provision. The Products and any related documentation are deemed "commercial computer software" and "commercial computer software documentation," respectively, within the meaning of the applicable civilian and military Federal acquisition regulations and any supplement thereto. If the user of the Product is an agency, department, employee, or other entity of the United States Government, the use, duplication, reproduction, release, modification, disclosure, or transfer of the Products, including technical data, manuals or other accompanying documentation, is restricted by the terms, conditions and covenants contained in the Google Maps/Google Earth Terms of Service and the Google Maps/Google Earth APIs Terms of Service. In accordance with Federal Acquisition Regulation 12.212 for civilian agencies and Defense Federal Acquisition Regulation Supplement 227.7202 for military agencies, use of the Products is further restricted by the Google Maps/Google Earth Terms of Service and the Google Maps/Google Earth APIs Terms of Service.
3Tele Atlas Licensed Content.
3.1Restrictions on Commercial Use of Tele Atlas Licensed Content.
(a) You are not permitted to print more than 5,000 copies of sales collateral materials containing a screenshot of Tele Atlas Licensed Content for commercial sales lead generation ("Direct Marketing"). If you desire to do so, you must (i) enter into a Google Enterprise license agreement or (ii) contact Tele Atlas to obtain a direct license to do so.
(b) You are not permitted to incorporate Tele Atlas Licensed Content as a core part of printed matter (such as printed maps or guide books) that you redistribute for a fee. If you desire to do so, you must contact Tele Atlas to obtain a license.
(c) You are not permitted to offer a batch geocoding service that uses the Tele Atlas Licensed Content contained in any Google products or services.
3.2Restrictions on Government Use of Tele Atlas Licensed Content. If Licensed Content provided by Tele Atlas is used or accessed by or on behalf of the United States government or any other entity seeking or applying rights similar to those customarily claimed by the United States government, such use or access is subject to the following provisions:
(a)U.S. Government Limited or Restricted Rights. If you are an agency, department, or other entity of the United States Government, or funded in whole or in part by the United States Government, then your use, duplication, reproduction, release, modification, disclosure or transfer of this commercial product and accompanying documentation, is restricted in accordance with the LIMITED or RESTRICTED rights as described in DFARS 252.227-7014(a)(1) (JUN 1995) (DOD commercial computer software definition), DFARS 227.7202-1 (DOD policy on commercial computer software), FAR 52.227-19 (JUN 1987) (commercial computer software clause for civilian agencies), DFARS 252.227-7015 (NOV 1995) (DOD technical data - commercial items clause); FAR 52.227-14 Alternates I, II, and III (JUN 1987) (civilian agency technical data and noncommercial computer software clause); and/or FAR 12.211 and FAR 12.212 (commercial item acquisitions), as applicable. In case of conflict between any of the FAR and DFARS provisions listed herein and this license, the construction that provides greater limitations on the Government's rights shall control. (b)Protection from Public Disclosure. If you are an agency, department, or other entity of any State government, the United States Government or any other public entity or funded in whole or in part by the United States Government, then you hereby agree to protect the Licensed Content from public disclosure and to consider the Licensed Content exempt from any statute, law, regulation, or code, including any Sunshine Act, Public Records Act, Freedom of Information Act, or equivalent, which permits public access and/or reproduction or use of the Licensed Content. If such exemption is challenged under any such laws, this license agreement will be considered breached and any and all right to retain any copies or to use of the Licensed Content will be terminated and considered immediately null and void. Any copies of the Licensed Content held by you will immediately be destroyed. If any court of competent jurisdiction considers this clause void and unenforceable, in whole or in part, for any reason, this license agreement will be considered terminated and null and void, in its entirety, and any and all copies of the Licensed Content will immediately be destroyed.
3.3Additional Restrictions on Use of Municipal Boundaries. Tele Atlas Licensed Content containing municipal boundaries must not be used to create or derive applications that are used for the purpose of tariff or tax rate determination for a particular address or range of addresses.
4Country-Specific Notices.
4.1 Australia and New Zealand
The data used to create the mapping images or map based content for Australia or New Zealand are copyrighted © by MapData Sciences Pty Ltd or one of its licensors (see www.nowwhere.com.au/lic/NowWhereLic1.htm). Use of such data is permitted only for Google Services. It is a condition of the license that any unauthorized copying or reproduction of the content in any form, or by any means, is not permitted. Without in any way limiting the generality of the above, you or any user of this data shall not copy any of the content by any means including magnetic, digital, rasterizing, scanning, digitizing, any electrostatic method, fax or photocopying. You may not attempt to reverse engineer any output that would allow the recreation of any digital mapping data, including but not limited to any form of geocodes.
